A Certificate of Sponsorship (CoS) is a digital reference number issued by UK employers licensed by the Home Office, essential for foreign nationals applying for work visas. This electronic record confirms that the employer has extended a job offer and that the position meets the necessary visa requirements. The CoS includes details such as the job’s start and end dates, the sponsoring organisation’s information, and the unique reference number used in the visa application process.
 
Several UK visa categories require a CoS, including the Skilled Worker visa, Intra-Company Transfer visa, and various Temporary Worker visas. The certificate ensures that the job aligns with the required skill level and salary threshold, verifying that the overseas worker possesses the necessary qualifications and experience.
 
Employers must adhere to strict compliance obligations when issuing a CoS. The certificate is valid for three months from the date of issuance, and the associated visa application must be submitted within this timeframe. Sponsors are responsible for maintaining accurate records in the Sponsorship Management System (SMS), ensuring that the job role meets the necessary criteria, and verifying the applicant’s qualifications.
 
There are two primary types of CoS: Defined and Undefined. Defined CoS are for applicants applying from outside the UK under the Skilled Worker route and require prior approval through the SMS. Undefined CoS are for applicants already in the UK or those applying under other visa categories and can be issued without prior approval, provided the employer has an available allocation.
 
Employers seeking to sponsor foreign workers must obtain a Sponsor Licence from the Home Office. The application process involves demonstrating that the organisation is genuine and operating legally in the UK, has appropriate HR systems to monitor sponsored employees, and appointing key personnel to manage the sponsorship process. Relevant fees apply, varying depending on the organisation’s size and type. Once the licence is granted, employers can issue CoS to eligible workers, ensuring compliance with all sponsorship duties.
 
Employers must ensure that the job role offered to the foreign worker meets the appropriate skill level and salary requirements as specified by UK Visas and Immigration (UKVI). Additionally, they must verify that the applicant has the necessary qualifications and experience for the role. Non-compliance can lead to penalties, including the revocation of the Sponsor Licence.
