Kevin (Xinze) Liu

OVERVIEW

Kevin Liu graduated from China University of Political Science and Law, and is a visiting scholar at Fordham University. Kevin is also a member of the China Council for the Promotion of International Trade (CCPIT), Shaanxi Sub-Council, a member of the Commercial Legal Experts of the CCPIT, Qingdao Sub-Council, and a member of the Legal Experts of the CCPIT, Huzhou Sub-Council.

EXPERIENCE

Kevin specializes in trade remedy areas such as international anti-corruption, international asset recovery, export control, anti-dumping and countervailing, cross-border investment mergers and acquisitions, etc.  As a Chinese lawyer, he has represented the U.S. China Chamber of Commerce on many occasions at the US 301 investigation hearing, and assists Chinese companies in dealing with mergers and acquisitions in the United States. Kevin also has extensive practical experience in international asset recovery. He has handled several international asset recovery cases. In 2018, Kevin participated in the APEC Anti-Corruption Law Enforcement Cooperation Network Training Course organized by the Central Supervision Commission in Thailand.

REPRESENTATIVE MATTERS

• Provided special legal services for a Chinese enterprise in the Philippines industrial investment project in January 2019
• Commissioned by the Linyi City Supervision Committee to provide legal services for the pursuit of the former Economic and Trade Commission director Mohai Cui in 2018
• Represented a Chinese construction group in a multinational (U.S.) debt recovery in 2018. It is the first time that a Chinese law firm involving in such asset recovery cases. The U.S. court has accepted the case and supported the plaintiff’s argument. The case has created a precedent for the new model of asset recovery in China.
• Represented a Chinese firm to repond to the U.S. anti-circumvention investigation in Cambodia, Vietnam and other countries
• Attended the U.S. 301 investigation hearing as a representative of U.S.-China Chamber of Commerce from October 2017 to the first half of 2018, and actively safeguarded the rights and interests of Chinese companies in the United States
• Represented a large U.S. auto parts company to apply for 301 product exclusion from USTR
• Represented the China Rubber Group of trademark case from 2017 to 2019
• Represented a foreign company in China for trademark infringement disputes in 2017
• Participated in the US anti-dumping case against Chinese truck and bus tires, successfully exclude the only state-owned enterprise from the order
• Represented a Chinese company in India’s anti-dumping case against Chinese truck and bus tires,  successfully appealed and obtained zero tax rate during the first anti-dumping investigation
• Represented Chinese companies in Canada’s anti-dumping case against Chinese copper pipe fittings, successfully get the result of zero tax rate for the two responded Chinese companies
• Represented Chinese companies in Canada’s anti-dumping case against China’s built-in spring group and obtained the lowest normal value in three re-investigations
• Represented Chinese companies in Brazil’s investigation of China’s glyphosate sunset review, and successfully reduce the tax rate from 35.87% to 2.1%. The case is one of the most successful case of defense against Brazil
• Represented Chinese companies in Egypt’s anti-dumping case against Chinese tires, and obtained a minimum tax rate of 3.8% for Chinese tire companies
• Represented a Shandong tire manufacturer to apply for a new exporter review in Russia. It was the first time a Chinese company submied a new exporter review application to Russia
• Participated in Master Kong and China Pepsi Equity Acquisition Project, Cooperation with Starbucks, Cooperation with Disney Beverage Monopoly, Natural Water Mine Acquisition Project
• Participated in dozens of gas stations and gas station acquisition projects of Zhongmin Huaheng, Zhongmin Youneng, Zhongmin Ronghe and other companies
• Participated in acquisition of Sinochem Modern Agriculture Co., Ltd. And an agricultural technology company; acquisition of Sinochem Fertilizer Co., Ltd. and a chemical company
