Currently, several areas of IP advocacy are particularly active, driven by various trends and challenges:
i. Brand Protection: With the rise of e-commerce and digital marketing, companies are increasingly focused on protecting their brands from counterfeiting and unauthorised use. The proliferation of online marketplaces makes it easier for counterfeit products to reach consumers, prompting brands to enhance their protection strategies.
ii. Copyright Registration & Protection: The digital content boom, especially in streaming services, social media and user-generated content, has led to heightened focus on copyright issues. Creators are more aware of the need to protect their works from infringement, leading to increased registrations and legal actions. However, infringers always manipulate usage through fair use.
iii. IP Audit, Infringement & Investigation: As IP theft becomes more sophisticated, businesses are investing more in investigation services to identify and combat infringements. This area is particularly active as companies seek to maintain their competitive edge.
iv. Trade Secret/Dress Protection: As businesses rely more on proprietary information and technology, protecting trade secrets has become critical. Such industries as tech and pharma are especially vigilant, as the loss of trade secrets can have significant competitive repercussions.
Safeguarding IP is indeed crucial for businesses. The list below summarises the key challenges, and how we deal with them:
i. IP laws vary significantly across countries, making international protection complex in light of these global considerations. To address this, we work with legal experts to understand and navigate international IP laws, and consider filing for protection in key markets through such treaties as the Patent Cooperation Treaty (PTC).
ii. Rapid technological advancements render existing IP strategies obsolete. To address this, we stay updated on industry trends, and continuously reassess and adapt IP strategies to align with new technologies and market changes.
iii. Cost of protection. To address this, we prioritise which IP to protect based on strategic value, and explore statutory remedy or resources that support IP protection.
iv. Digital threats. To address this, we advise clients to invest in robust cybersecurity measures, including encryption, firewalls and regular audits – in order to safeguard digital assets.
v. Lack of awareness. Often, clients inadvertently expose their IP by sharing sensitive information. To address this, we provide training to educate clients on the importance of IP, as well as best practices for protection.
Enforcing IP rights on a cross-border scale involves several challenges and complexities, including: diverse legal frameworks, variability in enforcement mechanisms, as well as jurisdictional issues. Determining the appropriate jurisdiction for legal action is complex, especially in cases involving online infringement or international trade. Cost of enforcement is another key challenge, alongside language barriers, as these may affect legal documents, contracts and the translation of communications – which can introduce errors and misunderstandings, further complicating enforcement efforts.
Due diligence is crucial at the beginning of an IP case for several reasons:
i. Risk Assessment: Conducting thorough market surveys and IP searches helps us to identify potential risks, including existing trademarks or patents that could conflict with your IP. This assessment prevent costly legal disputes down the line.
ii. Strengthening IP Claims: Gathering evidence of prior use, market presence and consumer recognition during due diligence bolster our cases. This information is critical when asserting rights or defending against infringement claims.
iii. Avoiding Wasteful Investment: By identifying potential legal barriers early on, businesses can avoid investing in products or services that may infringe on existing rights, thereby saving time and resources.
iv. Compliance & Legal Obligations: Ensuring compliance with local laws and regulations through due diligence can prevent legal pitfalls and enhance the standing in case of disputes.
To ensure a well-informed advisory scope for clients operating in differing jurisdictions, we take the following steps:
i. We stay updated on the laws, regulations and IP frameworks of the jurisdictions relevant to our client. This includes understanding local customs, enforcement practices and recent legal developments.
ii. We collaborate with local legal experts or firms/agents who have a deep understanding of the specific jurisdiction. Their insights can provide valuable context and help navigate local nuances.
iii. We maintain open lines of communication with the client and any local partners.
iv. We identify and analyse potential risks associated with operating in various jurisdictions. This includes IP infringement risks, compliance issues, as well as cultural considerations that may impact enforcement.
v. We make sure that all advice is well documented and clearly articulated. This helps the client understand the implications of our recommendations and their rationale.
